Can a report from my family law proceedings be used in another court?
Section 121 Family Law Act provides an exception to publication of material that will become a criminal offence. This means that the communication to persons concerned in proceedings in any court of any pleading, transcript of evidence or other document for use in connection with those proceedings may be used.
The 2016 case Miller & Murphy reinforced the provisions of the legislation.
This means that any material relevant to the family law proceedings dealing with conduct of one or both of the parties may be submitted to a local court in dealing with domestic violence and related criminal proceedings. Taken it further it means that a child the subject of domestic or sexual abuse may use such material in criminal or civil action in the future.
