Under the Child Support (Assessment) Act 1989 both parents have a primary duty to support their child. This duty has priority over all other commitments of a parent. When parents no longer live together or have never lived together the parent’s duty continues. The amount to be paid by one parent to the other who has the primary care of the child is calculated by reference to many factors such as:
- The parent’s income
- The number of children cared for by each of the parents
- The living arrangements for the child and each of the parents
The Department of Human Services is a Commonwealth Department now responsible for administering Australia’s Child Support Scheme.
