The provisions of the Succession Act 2066 (NSW) sets out at length who the court will consider to be an eligible beneficiary and therefore who may make a claim on the estate of the deceased. Consider if you fall into the following categories:
- A spouse at the time of the death of the testator
- A former spouse of the deceased
- A de facto partner as at the date of death of the deceased
- A person who was in a domestic relationship with the deceased
- A person who lived in a close personal relationship with the deceased as at the death of the deceased
- A child of the deceased
- A person who at any time was partly or wholly dependent on the deceased
- A grandchild of the deceased
- A person who lived in the household of the deceased
- A child born as a result of sexual relations between the parties to the relationship
- A child for whose long term welfare was the responsibility of the deceased
