How should I prove domestic violence in my household?
The trial judge in Janssen & Janssen [2016] FamCA 345 acknowledged how difficult it is to obtain evidence of alleged family violence which takes place behind closed doors. Therefore he was prepared to accept voice recordings and a transcript of those recordings of the robust exchanges between the parties to the proceedings. The recordings had been made by the mother without the father’s knowledge. She sought to rely on the recordings in support of her allegations.
The judge was satisfied that the mother’s actions were reasonably necessary in light of her allegation that the father had a “charming public face” but engaged in family violence in the home.
