When signing your will Fay will ensure that the will is witnessed by 2 independent adults who are not referred to in the will as executors, or trustees or beneficiaries. The will must be signed in the presence of the witnesses who are watching as the will is signed. The witnesses must also sign the will so that the testator and the second witnesses are closely watching the execution.
If there is any doubt as to whether the will was signed correctly then a court may take evidence at a hearing to determine the procedures that have been followed.
It is important to record on the will the name and address of the witness so they may be contacted in the future if the will is called into question as not having been correctly executed.
